Robbed of Overtime Pay? ( IBM Settles )
Tech companies want all the advantages. They want to exchange the lowest possible compensation package for as much of your labor as they can get. They'll even try to trick you into thinking you're management so they don't have to pay you overtime. If your skills are worth so much to them, they should be paying you a higher base salary—but then they'd have to pay benefits to you at higher levels.
IBM didn't get away with trying to exempt 32,000 "Technical Services Professional and Information Technology Specialists." It cost them a lump sum of $65M – they still win – they earned interest while workers waited to be reimbursed.
If you wonder whether the job you're doing is considered management—exempt from overtime, or labor—hourly waged and overtime eligible, read the guidelines the National Labor Relations Board has developed.
Don't get ripped off by the hand that needs you.
